Terms of Use

These terms are an agreement between you and Kratue (“we”, “us”), the operator of Tagbit. They cover the Tagbit apps for iPhone and Android, the Tagbit App Clip, the web console and the pages that open when a Tagbit tag is tapped (together, “Tagbit”). By using Tagbit you agree to them. If you don’t agree, don’t use Tagbit.

1. What Tagbit does

Tagbit lets you program NFC tags with a permanent link, and choose and change what that link does: share Wi-Fi, a contact card, a link, a phone number, an email, a message, a location or a note. Tagbit is free. The free plan has limits, such as the number of tags you can have, which are shown in your profile. We may change features and limits over time.

2. Your account

  • You need to be at least 13, and old enough to agree to these terms where you live, to create an account.
  • Give accurate information, keep your sign-in secure, and tell us if you think someone else has used your account.
  • You’re responsible for what happens in your account.
  • You can delete your account at any time in the app or the web console. This permanently deletes your tags, and they stop working.

3. Your content

What you put on your tags (links, contact details, Wi-Fi details, notes and so on) is yours. You give us permission to store it, process it and show it to people who tap your tags, only as needed to run Tagbit. You’re responsible for your content and for having the right to share it, including other people’s contact details and Wi-Fi networks you share.

4. Acceptable use

Don’t use Tagbit to:

  • break the law or help anyone else do so;
  • link to phishing, malware, scams or other harmful content, or mislead people about where a tag leads;
  • harass, threaten or impersonate anyone, or share someone’s personal information without permission;
  • infringe anyone’s intellectual property or other rights;
  • send spam or unsolicited messages;
  • tamper with tags you don’t own, or place tags where you don’t have permission;
  • get around our security, PIN protection or rate limits, access accounts or data that aren’t yours, or overload our systems.

We may turn off tags or suspend accounts that break these terms or put others at risk. If you see a tag being misused, email us the tag’s link at hello@kratue.com.

5. Tags in the physical world

You’re responsible for the NFC stickers and cards you use and where you put them. A tag only works while its account exists and Tagbit is running. Anyone can read a tag’s link, so use a PIN for anything private, and lock tags placed in public so they can’t be overwritten.

6. Other services

Tagbit works with services from other companies, such as sign-in with Apple or Google, and Google’s Gemini if you add your own API key to the app. Your use of those services is covered by their terms. We aren’t responsible for them.

7. Our rights

Tagbit, including its software, design and name, belongs to Kratue. We give you a personal, non-exclusive, non-transferable licence to use it in line with these terms. Don’t copy, modify or reverse-engineer it, except where the law allows this despite these terms.

8. Changes and ending

We may update these terms. If a change is significant, we’ll tell you in the app or by email before it takes effect; continuing to use Tagbit after that means you accept the new terms. You can stop using Tagbit at any time. We may stop providing Tagbit, or end your access for a serious or repeated breach of these terms; where we reasonably can, we’ll give notice first.

9. Disclaimer

Tagbit is provided “as is” and “as available”. To the extent the law allows, we make no warranties, express or implied, including that Tagbit will be uninterrupted, error-free or fit for a particular purpose, or that every phone can read every tag.

10. Limitation of liability

To the extent the law allows, Kratue won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or revenue, arising from your use of Tagbit. Our total liability for any claim about Tagbit is limited to US$50. Some places don’t allow these limits, so they may not apply to you.

11. Indemnity

If someone makes a claim against us because of your content or your breach of these terms, you agree to cover our reasonable costs and losses from that claim, to the extent the law allows.

12. Governing law

These terms are governed by the laws of the United States and of the state where Kratue is established, without regard to conflict-of-law rules. This doesn’t take away any rights you have under the consumer protection laws of the place where you live.

13. Apps from the Apple App Store

If you got Tagbit from Apple’s App Store, these terms also apply:

  • These terms are between you and Kratue, not Apple. Kratue, not Apple, is responsible for the app and its content.
  • Your licence to use the app is limited to Apple-branded devices you own or control, as allowed by the App Store Terms of Service.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to meet any applicable warranty, you may tell Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
  • Kratue, not Apple, is responsible for any claims relating to the app, including product liability, failure to meet legal or regulatory requirements, consumer protection or privacy claims, and claims that the app infringes someone’s intellectual property.
  • You confirm that you aren’t in a country subject to a US Government embargo, and that you aren’t on any US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
